Bytalus, in conjunction with animal law experts Guardianz offers services in “animal law” – which includes anything that involves an animal, for example, animal welfare (from dog control through to dairy, pig, poultry and other production systems), food safety, biosecurity and border control, in addition to imports/exports, fisheries and trade.

 

In addition to representation, we sit at the senior planning and management tables of clients and do file reviews collaborating with other lawyers with a view to making sure nothing is overlooked in looking after you.

 

We have had recent success in Ministry of Primary Industries animal law farm animals’ prosecutions and Food Act prosecutions where the outcomes for our clients resulted in unprecedented success. Importantly, in each of these cases, there was complete agreement between the Judge, the prosecution, the defence, and the client that this was “fair” and “the right outcome”. The outcome was significantly less than the Ministry’s starting point. Through our defence work in Ministry of Primary Industries prosecutions, we have developed a good working relationship with MPI, focussing on resolving complaints and prosecutions through open consultation and where an acceptable result is not forthcoming then challenging the prosecutions formally through a ‘not guilty’ hearing.

 

Recognising there is a problem and obtaining our advice early has saved our clients thousands of dollars in legal fees. We have successfully avoided the filing of pending prosecutions through early engagement with MPI and SPCA.

 

We also provide advice to local Councils and offer various trainings in Animal Welfare law.

CYBER LAW, Privacy and Harrassment

Your privacy and protection in an online world is just as important in the real world.  At times, through no fault of our own, our online privacy and online identities can be violated.  The repercussions of these digital privacy violations can be distressing and long lasting.  The Harmful Digital Communications Act 2015 enables individuals who commit criminal offences using digital communications to be prosecuted.  The Act defines harm for victims of cybercrime as ‘serious emotional distress’.  Should you experience serious emotional distress by falling victim to cyber and/or privacy crimes, we can advise you on how to proceed with strengthening your online protection and seeking prosecution against your perpetrator.  We can also provide you with advice if you have been defamed or you are being harassed.
